Hard-to-insure small business in Florida: what E&S means (and when it isn’t the only option)

Someone told you the class is “too risky.” The online form bounced. A standard market said no. That is not always the end of the story.

In Florida, some small businesses land in excess and surplus (E&S) — specialty markets that write risks admitted carriers often skip. E&S is a real tool. It is not a personality type, and it is not the only door an independent agency can knock on.

What E&S actually means in plain words

Admitted (standard) markets are licensed in Florida and sit under state guaranty protections that apply to those companies. E&S markets are surplus-lines placements: often used when appetite is thin, the operation is unusual, or the loss history is heavy. The paperwork, disclosure, and tax treatment can differ. We will not invent your form here.

“Hard to place” can mean the class is specialty, the location is coastal, the work includes something the standard app never asked about, or the last claim made the next underwriter nervous. Sometimes the fix is better information. Sometimes it is a different market. Sometimes E&S is the honest answer.

When it isn’t the only option

An independent agent can shop more than one door — standard markets that still write your class, package products when the risk is clean enough, or specialty when it is not. One “no” from one portal is not a statewide rule.
